Heard learned counsel for petitioner and learned Government Pleader for Revenue.
The writ petition is directed against the order of the Commissioner of Appeals dated 20.01.2014 and the primary grievance of the petitioner is that the Commissioner advanced the date of hearing from 12.04.2014 to 04.01.2014 without notice to him.
Initially when this Court admitted the writ petition and granted interim suspension on 06.02.2014, the order of interim suspension was questioned by the 5th respondent by way of an appeal in W.A.No.272 of 2014. During the hearing of the said appeal, the contesting parties namely the writ petitioner as well as the 5th respondent conceded for setting aside the order of suspension passed by this Court on 06.02.2014 and also consented for setting aside the order of the Commissioner of Appeals, dated 20.01.2014, which is impugned in the writ petition. Accordingly, the Division Bench, while disposing of the said appeal, by order dated 11.03.2014, set aside both the said orders and directed the appellate authority to hear the matter afresh in accordance with law and record reasons. In view of the said order of the Division Bench, nothing further remains to be adjudicated in the writ petition, as the order impugned is already set aside.
The writ petition is therefore disposed of directing the appellate authority and the Chief Commissioner of Land Administration to hear all the parties affected and dispose of the matter afresh by giving reasons as directed by the Division Bench. The Division Bench had already granted two months’ time to dispose of the appeal. However, since the writ petition is pending and being disposed of now, if the appeal is not yet disposed of, the appellate authority is directed to dispose of the same as expeditiously as possible, in any case, within six weeks from today, as per the Division Bench order. There shall be no order as to costs.
The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
