PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus calling for the records in Rc.42858/EB1/1996 dated 3.09.2010 on the file of the first respondent and quash the same as illegal and direct the respondents to provide continuous employment to the petitioners in any department of Government of Tamil Nadu.

O R D E R
Heard Mr.R.Sankara Subbu, learned counsel for the petitioners and Mr.S.Diwakar, learned Special Government Pleader appearing for the respondents.
2. The petitioners seek for issuance of a Writ of Certiorarified Mandamus to call for the records in Rc.42858/EB1/1996 dated 3.09.2010 on the file of the first respondent and quash the same as illegal and direct the respondents to provide continuous employment to the petitioners in any department of Government of Tamil Nadu.
3. The respondents have filed their counter affidavit.
The learned Special Government Pleader has relied upon paragraph 12 of the counter affidavit, which reads as follows:
"It is submitted that after receipt of remarks from the Director of School Education regarding equivalence of educational qualification possessed by the petitioners observation made by the Tamil Nadu Public Service Commission and the petitioners representation regarding their appointment as Office Assistants, they were appointed as Office Assistants by first respondent (on 05.12.2012) only after getting their willingness.
Accordingly, they joined duty and they have also given undertaking to withdraw the writ petition."
4. The Writ Petition is pending before this Court from the year 2011. In view of the statement made in the aforesaid paragraph in the counter, the Writ Petition is dismissed. No costs. Consequently connected miscellaneous petition is closed.
