THIS PETITION COMING ON FOR ADMISSION THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Though this petition is listed for admission, with the consent of the learned counsel for the petitioner and the respondent, heard arguments on merits for final disposal.
2. The petitioner-wife is seeking transfer of M.C.No.58/2017 pending before the Family Court, Hassan to the Family Court, Mysuru.
3. The petitioner is the legally wedded wife of the respondent. They were married on 23.05.2011 at Mysuru. Out of the wedlock, the petitioner has delivered a male baby on 22.03.2012. Thereafter, on account of harassment done by the respondent-husband, the petitioner was compelled to leave the house of her husband and she is residing in her parents house at Mysuru. The petitioner is unemployed and she does not have any independent source of income, as such she is unable to attend the Court proceedings at Hassan.
4. Learned counsel for the respondent-husband has fairly submits that the M.C. petition may be transferred as prayed for by the petitioner-wife. He further submits that the direction may be issued to the concerned Court for early disposal of the matter.
5. In view of the facts and circumstances of the case, this civil petition is allowed. M.C.No.58/2017 pending before the Family Court at Hassan is ordered to be transferred to the Family Court at Mysuru.
6. Both the parties shall co-operate for early disposal of the matter.
7. Registry is directed to issue intimation to the Family Court, Hassan, for transmission of records.
