ORDER:
This writ petition is filed feeling aggrieved by the condition imposed by respondent No.3 that the petitioner shall furnish bank guarantee for a sum of Rs.70,000/-, for release of his auto seized along with alleged PDS rice.
A perusal of the record shows that through his endorsement in Roc.E4/747/2014 dated 30.10.2014, respondent No.3 has directed the petitioner to produce FDR for Rs.70,000/- as a condition for releasing his mini goods vehicle.
In my opinion, it is not appropriate for this Court to interfere with the discretion exercised by respondent No.3, pending proceedings under Section 6-A of the Essential Commodities Act, 1955, by stipulating the condition mentioned above for release of the petitioner’s auto. Hence, I do not find any reason to interfere with the impugned proceedings.
The writ petition is accordingly dismissed.
As a sequel to the dismissal of the writ petition, W.P.M.P.No.44422 of 2014 shall stand disposed of as infructuous.
