THE HON’BLE SRI JUSTICE S. RAVI KUMAR CRIMINAL PETITION No. 2628 of 2012 ORDER:
This criminal petition is filed to quash FIR in crime No.64 of 2012 of P.M. Palem Police Station for the alleged offence under Section 498-A IPC and 3 and 4 of Dowry Prohibition Act.
2. Heard both sides.
3. I have perused the material papers filed along with the quash petition. On the last adjournment, learned Public Prosecutor was directed to get the case diary in crime No.704 of 2011 of III Town Police Station, Visakhapatnam for which learned Public Prosecutor submitted that as per the instructions received the said crime was registered under woman missing and the said woman was traced out on the very next day of registering the FIR and that is the information available with the police. Here, the 1st petitioner is the husband, 2nd petitioner is the mother-in-law, 3rd petitioner is the father-in-law of the defacto-complainant.
4. Considering the contentions and rival contentions and the relationship of both the parties, I feel it appropriate to direct the police to complete investigation as expeditiously as possible and file a final report and till such period, not to arrest petitioners 2 and 3, who are the in-laws of the defacto-complainant, this petition can be disposed of.
5. Accordingly, the criminal petition is disposed of directing the police to expedite the investigation and file the final report as early as possible. In the meanwhile, not to arrest petitioners 2 and 3 i.e., in- laws of the defacto-complainant till completion of investigation. 1st petitioner can avail the remedy as available under law for getting bail.
As a sequel, miscellaneous petitions, if any, filed in this criminal petition, shall stand dismissed.
