Heard learned counsel for the applicant as well as learned A.G.A. for the State.
By way of the instant application, the applicant has prayed for a direction to expedite the Complaint Case No.1769 of 2016 (M/s P.S.Gold Storage vs. Ramgopal Tyagi) under section 138 N.I.Act, PS.New Agra, District Agra pending in the court of Additional Chief Judicial Magistrate Court No.2 Agra.
In this case, the applicant happens to be complainant and it wants expeditious disposal of the aforesaid case as the proceeding is pending since 2016.
I have considered the submissions advanced by counsel for the applicant and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C.
In view of the matter, this application is disposed off with the direction that the trial court will expedite and dispose of the aforesaid case in accordance with law expeditiously from the date of production of a certified copy of this order before it, after affording opportunity of hearing to the parties concerned, if there is no legal impediment, within a period of three months.
