THIS WRIT PETITION IS FILED UNDER ARTICLES 226 & 227 OF THE CONSTITUTION OF INDIA, PRAYING TO DIRECT THE RAILWAY ADMINISTRATION TO ISSUE THE GENERAL TICKETS IN LINE WITH THE CAPACITY OF THE GENERAL COMPARTMENTS IN EVERY MAIL/EXPRESS TRAINS AND NOT MORE THAN THE CAPACITY OF GENERAL COACHES TO PREVENT TIGHT RUSH IN ALL TRAINS IN INDIAN RAILWAYS.
THIS PETITION COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP THIS DAY, CHIEF JUSTICE, MADE THE FOLLOWING:
ORDER Heard the petitioner appearing in person.
2. In this writ petition, which is in the nature of public interest litigation, prayer is made for seeking writ of mandamus.
3. Before seeking a writ of mandamus by filing this petition, the petitioner has not made any representation to the respondent making the grievances which are raised in the petition. Only on this ground, we decline to entertain this writ petition under Article 226 of the Constitution of India. Accordingly, the petition is rejected. However, the rejection of the petition will not prevent the petitioner from making appropriate representation to the respondent.
