Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to; forthwith appoint the petitioner herein to act an probation as Deputy Superintendent of Police (Category I) in the Tamil Nadu Police Service in the Most Backward Class Category pursuant to his selection and communicated in Memorandum No.2538/OTD-C1/99 dated 05.08.2003 and in Memorandum No.2538/OTD-C1/99 dated 22.04.2004 on the file of the 2nd respondent without selecting or recruiting any other candidate to the post of Deputy Superintendent of Police (Category I) in the Most Backward Class Category for the year 2000-01.
For Petitioner : Mr.K.Soundararajan For Respondents : Mrs.K.Bhuvaneswari Government Advocate O R D E R Today, when the matter is taken up for consideration, the learned counsel appearing for the petitioner submits that the petitioner has been promoted as Superintendent of Police and made the following endorsement in the petition:
“Since the petitioner has been promoted as Superintendent of Police, nothing now remains to adjudicate. Hence the W.P. may be closed.”
2.Recording the endorsement made by the learned counsel appearing for the petitioner, this writ petition is dismissed as infructuous. No costs. Consequently, the connected miscellaneous petition is also closed.
