HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 11378 of 2010
ORDER:
Heard the learned Counsel for the petitioner, learned Standing Counsel for the first respondent and learned Government Pleader for the second respondent.
This Writ Petition was filed challenging the action of the respondents in interfering with the construction activity of the petitioner in the premises bearing No.8-1-43/A, admeasuring 80 square yards situate at Hyderabad Road, Siddipet town and Mandal, Medak District.
The learned Counsel for the petitioner submits that this Court by interim order dated 13.06.2012 directed the respondents not to interfere with the construction activity of the petitioner and by virtue of the said order, construction of the building was completed and nothing remains for adjudication in the Writ Petition.
However, the learned Government Pleader appearing for the second respondent submits that the land in which building was constructed by the petitioner belongs to the Government.
In view of the claim made by the Government, it is left open for it to take out appropriate proceedings in accordance with law in respect of its claim. It is made clear that the order now passed does not prevent the Government to take such action.
Recording the submission of the learned Counsel for the petitioner, the Writ Petition is closed.
Consequently, miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No costs.
