JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED: 29.06.2017
C O R A M
THE HONOURABLE MR.JUSTICE M.GOVINDARAJ W.P.NO.27627 OF 2004
P.Palpandi ... Petitioner
Vs.
The Secretary Department of Tamil Development and Culture Secretariat, Chennai - 600 009. ... Respondent PRAYER: Petition filed under Article 226 of Constitution of India to issue a Writ of Mandamus, directing the respondent to dispose of the representation of the petitioner dated 16.07.2004 which is pending on the file of the respondent.
For Petitioner : Dr.G.Krishnamurthy For Respondent : Mr.R.Prathap Kumar Additional Government Pleader O R D E R The writ petitioner has preferred the above writ petition for disposal of his representation dated 16.02.2004 and for an interim direction directing the respondent to permit the petitioner to participate in the interview being conducted for recruitment of Lecturers and Headmasters of Musical College and Schools.
2. Though the prayer sought for is very vague in nature, the representation reveals so many allegations and irregularities on the part of the members of the Music College. The petitioner would claim that there were larger irregularities in collecting donations for conducting functions in the College. He would further state that he was forced to give a letter admitting his guilt that he had misappropriated money by printing donation books. However, he was not considered for selection in the Music College and Schools. The petitioner would pray for disposal of the above representation dated 16.02.2004.
3. The respondent has filed a counter affidavit setting out all the details and the fact that he was also considered for selection which he admitted in his own letter dated 03.09.2003 addressed to the Hon'ble Chief Minister's Cell that he would call for the interview held on 22.08.2002 for the post of Lecturer (Vocal) and also requested early appointment order. The respondent would further state that the petitioner has indulged in various activities upsetting the peace and harmony of the college as well as indulged in the misconduct of printing donation books and collecting money from students and various people. The petitioner himself has admitted the guilt by his own letter. Despite the same, the learned counsel appearing for the respondent would submit that the petitioner was called for attending the interview and the grievance of the petitioner has already been redressed.
4. In the light of the above, this Court is the view that nothing survives in the writ petition for further adjudication and the representation need not be disposed of by yet another order. Accordingly, the writ petition is dismissed. No costs.
