.....Respondent/ Complainant Petition under Section 438 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, CCS, Nampally, Hyderabad to release the petitioner on. ball in the event of his arrest in connection with the Crime No.58/2014 of CCS, Nampally, Hyderabad and pass such other order or orders as this Honourable court may deem fit and proper in the circumstances of the case..
The petition coming on for hearing, upon perusing the petition and the Memo of grounds filed herein, and upon hearing the arguments of SRI D. KODANDARAMI REDDY Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:-
The petitioner is A-3. He seeks for grant of anticipatory bail. He allegedly committed offences under Sections 406, 419 and 468 IPC.
Learned counsel for the petitioner submitted that the petitioner did not commit any of the offences levelled against him.
The petitioner is 86 years old. He is a former M.L.A.
In view of the age of the petitioner and the nature of the offences alleged against him, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioner- A3 shall surrender before the II Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, within two (2) weeks from today. On such surrender, the learned II Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, shall enlarge the petitioner-A3 on bail on a bond of Rs.10,000/- (Rupees ten thousand only) with two sureties each in a likesum to his satisfaction.
