1. We have heard Ms.K.J.Vora, holding brief of Mr. K.H.Baxi. She states that though Mr.Baxi appeared in the delay condonation application, but he has no instructions to appear in the main Letters Patent Appeal and office has wrongly shown their appearance on behalf of the respondents. The statement of Ms.K.J.Vora is accepted. We have proceeded to hear Mr.Samir B.Gohil, learned counsel appearing for the appellant.
