INDIRESH-AGA) * * * THIS WRIT PETITION IS FILED PRAYING TO DIRECT THE RESPONDENTS TO CONSIDER THE REPRESENTATION AND APPLICATION OF THE PETITIONER DATED 29.08.2013 AND DATED NIL VIDE ANNEXURE-A AND B RESPECTIVELY BY EXERCISING THE POWER CONFERRED UNDER THE PROVISIONS OF THE KARNATAKA CIVIL SERVICES (APPOINTMENT ON COMPASSIONATE GROUNDS) RULES, 1996.
THIS WRIT PETITION COMING ON FOR ‘PRELIMINARY HEARING-B GROUP’ THIS DAY, THE COURT MADE THE FOLLOWING:
ORDER Heard the learned counsel for the petitioner and the respondents.
2. The petitioner has sought for the relief of issuance of writ of mandamus or direction in the nature of mandamus directing the respondents to consider the representation/application dated 29.08.2013 produced as Annexure-A and B to the writ petition whereby, the petitioner has sought for an appointment on compassionate grounds.
3. Learned counsel for the petitioner would submit that the application was submitted way back in the year 2013 and the respondent has yet to consider the same till date. The same has been kept pending till date and that the respondents have a bounden duty to consider the same in view of the right vested in the petitioner to seek for consideration of his case for appointment on compassionate grounds.
4. Learned Addl. Govt. Advocate would submit that he has been instructed to state that if a reasonable time is granted, the respondent No.3 would consider the representation at Annexure-A and B in accordance with law.
5. The submission of the learned Addl. Govt.
Advocate is placed on record. The writ petition is disposed off by directing the respondent No.3 to expeditiously consider and dispose off the application seeking for appointment on compassionate grounds. The consideration and disposal of Annexure-A and B shall be in accordance with law and within an outer limit of two months from the date of receipt of the copy of this order.
The writ petition stands disposed off accordingly.
