This petition under section 24 of the Code of Civil Procedure is filed by the petitioner-wife seeking to withdraw G.O.P.No.696 of 2013 from the file of Principal District Judge’s Court, Warangal, and transfer to Family Court, Ranga Reddy District at L.B.Nagar.
Heard the learned counsel for the petitioner.
In spite of service of notice, none appears for the respondent.
Petitioner seeks transfer of the case filed the respondent-husband seeking custody of the child before the Principal District Judge’s Court, Warangal, on the ground that she filed O.P.No.1194 of 2013 before the Family Court, L.B.Nagar, Ranga Reddy District, for restitution of conjugal rights and after the respondent deserted her, she has been staying at Hyderabad along with her parents.
Learned counsel for the petitioner submitted that the respondent is working and residing at Hyderabad. Therefore, it is convenient for both the parties to prosecute the matter at Ranga Reddy.
In Sumita Singh v Kumar Sanjay[1] the Hon’ble Supreme Court held that in matrimonial matters, convenience of the wife has to be taken into consideration.
Considering the above circumstances, this petition is allowed and G.O.P.No.696 of 2013 is hereby withdrawn from the file of Principal District Judge’s Court, Warangal, and transferred to Family Court, Ranga Reddy District at L.B.Nagar, for disposal along with O.P.No.1194 of 2013 in accordance with law.
Miscellaneous petitions pending in this petition, if any, shall stand closed.
