ORDER:
Heard learned Counsel for the petitioner and learned Government Pleader for respondents 1 and 2.
This Writ Petition was filed challenging action of respondents 1 and 2 in calling the petitioner to the police station in respect of the civil dispute.
A counter affidavit is filed on behalf of respondents 1 and 2 stating that the petitioner did not lodge any complaint with them. As per the averments of the petitioner, it is clear that she filed suit in O.S.No.361 of 2008 before the learned Junior Civil Judge, Ananthapur for declaration of title and injunction against her mother and elder brother and the same is pending. It is further stated that the respondent never called the petitioner to police station at any point of time.
In view of the averments made in the counter affidavit by respondents 1 and 2 that they never interfered with the civil dispute between the petitioner and her mother and elder brother, which is pending adjudication in O.S.No.361 of 2008, this Writ Petition is misconceived and is liable to be dismissed.
Accordingly the Writ Petition is dismissed. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
