This Criminal Original Petition has been filed to call for the records in Crime No.88 of 2013 on the file of the first respondent and quash the same.

The learned Additional Public Prosecutor submitted that the first respondent has closed the case registered against the petitioners in Crime No.88 of 2013, as mistake of fact in R.C.S.No.5 of 2013 and the same was filed before the Judicial Magistrate-II, Namakkal. He submitted that the referred charge sheet was also served on the de facto complainant on 17.03.2013.
3. Recording the said submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed. Consequently, the connected miscellaneous petition is also closed.
