Order on Criminal Misc. (Stay Extension) Application No. 2 of 2019
Heard Sri Pulak Ganguly, learned counsel for the revisionist and Sri Gyan Prakash, Senior Advocate assisted by Sri Sanjay Kumar Yadav, counsel for the C.B.I.
The counsel for the applicant submitted that the interim order was passed in the present revision by this Court and the interim order was extended from time to time. Now the trial Court is proceedings against the revisionist as it requires a specific order with respect to the continuation of the interim order passed by this Court. Hence, he has prayed that the interim order passed in the present application be extended.
Sri Gyan Prakash, learned Counsel for the CBI has though opposed the stay extension application but he could not dispute the fact that the interim order was passed in the present revision by this Court and which was also extended from time to time.
From the perusal of the order sheet of the present case it appears that the matter was lastly extended by this Court on 01.09.2016 and thereafter the connected revision with the present revision i.e. Criminal Revision No. 3799 of 2015 along with other revisions were listed and in the connected revision the interim order was lastly extended on 07.09.2017 and because of the matter is being connected to each other it appears no specific order was passed by this Court for extending the stay in the present case.
After considering the submission advanced by learned counsel for the parties has submitted an interim order passed by this Court in the present revision. Hence, the same has been extended till 04.07.2019 on which the date matter will be listed for final disposal along with connected revisions.
Office is further directed to print the particulars of all the connected revisions with the present revision on the next date.
