THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.18516 of 2014 ORDER :
The case of the petitioner is that he is the owner and possessor of Acs.2.13 guntas in Survey Nos.433/1, 433/2 and 433/3 of Kohir Village in Medak District. When the petitioner presented the sale deed, the Sub-Registrar refused to register without assigning any reasons. Aggrieved thereby this writ petition is instituted.
2. As seen from the record, no proof is filed in support of the contention that the document is presented before the Sub-Registrar and the Sub-Registrar refused to receive the same. As per the provisions of the Registration Act, whenever the document is presented for registration, at the threshold, the Sub-Registrar cannot refuse to receive the same and he has to receive and process the same and if he has any objection, he must communicate the same while returning the document.
3. In the circumstances, the Writ Petition is disposed of giving liberty to the petitioner to present the deed of conveyance before the Sub-Registrar and as and when such deed of conveyance is presented, the same shall be processed in accordance with law. If the Sub-Registrar has any valid reasons for not entertaining the document, he shall pass a reasoned order and communicate the same to the petitioner within a period of three weeks from the date of receipt of the document. There shall be no order as to costs.
Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
