The main grievance of the writ petitioner is that the 2nd respondent – Sub-Registrar of Assurances, is not registering the agreement of sale dated 31.01.2004 executed in his favour in respect of an extent of Ac.2.18 cents of land in Sy.No.51/2 situated in Daminedu village, Tirupati Rural Mandal, Chittoor District. Hence, the present writ petition is filed seeking appropriate directions.
The 2nd respondent in his counter affidavit while stating that the land in Sy.No.51/2 of Daminedu village was classified as assigned land and its transfer is prohibited under the provisions of Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977, has categorically asserted that at no point of time, the petitioner presented the alleged agreement of sale dated 31.01.2004 before him for registration, as such, the question of refusal to receive and register the document does not arise.
The petitioner has not denied the categorical assertion made by the 2nd respondent in the counter by way of reply.
In view of the uncontroverted averment made in the counter affidavit that the petitioner has not presented the alleged agreement of sale at any point of time before the 2nd respondent for registration, this Court does not see any reason to grant the relief prayed for in this writ petition.
Hence, the writ petition is devoid of merits and accordingly dismissed. No order as to costs.
As a sequel to the dismissal of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
