This writ petition is filed for a mandamus declaring action of the respondents in refusing to take the Demand Draft of the petitioner and accepting the Demand Draft of the third person and trying to release the stock without any cancellation or suspension and for a consequential direction to the respondents 3 and 4 not to interfere with the petitioner’s fair price shop.
2. The case of the petitioner is that he was appointed as fair price shop dealer in respect of Shop No.36 of Mallikarjunapalli village on permanent basis in 2008 and has been distributing essential commodities from the date of appointment without any complaint and his authorisation is being renewed from time to time and is valid up to 31-03-2015. While so, Even though the petitioner’s fair price shop authorisation is valid and subsisting, the respondent authorities refused to receive the demand drafts for supply of essential commodities. Aggrieved by the same, the present writ petition is filed.
3. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Civil Supplies.
4. Having regard to the facts and circumstances of the case and since it is stated that the authorisation of the petitioner is valid and subsisting, the respondents 3 and 4 are directed to supply the stocks by receiving the Demand Drafts towards essential commodities as long as the petitioner’s authorisation is valid and subsisting. However, this order will not preclude the respondent authorities from making appointments on regular basis or taking appropriate action in case the petitioner commits any violation of the Control Order, 2008.
With the above direction, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
