Order:
This Contempt Case is filed alleging willful disobedience of Order, dated 02-12-2013, in W.P.No.34609 of 2013, by the respondents.
This Court, by the abovementioned order, has directed respondent No.1 to positively consider the petitioner’s request for grant of patta following allotment of an extent of Acs.2-00 cents of land in Survey No.170/2 of Chennaiah Kunta Village, Tirupathi Urban Mandal, Chittoor District.
Purporting to consider the petitioner’s application, respondent No.1 has issued an endorsement on 16-12-2013 wherein he has informed the petitioner that, for the reasons mentioned in the said endorsement, till A.P.Bhoodan Yagna Board gives proper clarification, no further action can be taken in the matter.
A perusal of the record shows that as per the clarification given by the Bhoodan Yagna Board vide Proceeding No.BYB/B/312/2013, dated 19-02- 2014, the petitioner was allotted Acs.2-00 cents of land in Survey No.170/2 out of an extent of Acs.10- 00 cents donated by Sri Pandraveti Subba Reddy on 21-02-1959 and that another extent of Acs.10-00 cents in Survey No.192 was donated by Sri P.S.Gurava Reddy to the Bhoodan Yagna Board on 21-02-1956. In the Gazette Notification, dated 16- 09-1971, issued by the State Government under the A.P.Bhoodan and Gramdan Act, 1965, the extent of Acs.10-00 cents donated by Sri P.S.Gurava Reddy alone was notified, while the Acs.10-00 cents of land donated by Sri Pandraveti Subba Reddy has not been notified therein. In the light of these facts, the action of respondent No.1 in not granting patta to the petitioner cannot be viewed as constituting contempt. The petitioner is, however, left free to avail appropriate remedy for obtaining patta.
Subject to the liberty given to the petitioner as above, the Contempt Case is closed.
As a sequel, Miscellaneous Petitions, pending if any, shall stand closed.
