Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorari, calling for the records of the 1st respondent in connection with the impugned order passed by him in Na.Ka.No.B2/PR38/2014, dated 24.12.2014 and confirmed by the 2nd respondent in RC No.43547/AP2(2)/2015, dated 14.03.2016 and quash the same.

O R D E R
Heard Mr.M.Muthappan, learned counsel appearing for the petitioner and Mr.P.Sanjay Gandhi, learned Additional Government Pleader appearing on behalf of the respondents.
2. By consent of the parties, the Writ Petition is taken up for final disposal.
3. The learned counsel for the petitioner has submitted that the petitioner has submitted a mercy petition to the 3rd respondent on 29.04.2016, against the order passed in the appeal by the 2nd respondent. The said application was forwarded by the Superintendent of Police on 13.05.2016 to the Director General of Police / 3rd respondent and the same is pending before the 3rd respondent. The learned counsel for the petitioner has submitted that it is suffice that the 3rd respondent shall consider the said mercy petition in accordance with law, within the time frame that may be fixed by this Court.
4. The learned Additional Government Pleader appearing for the respondents has submitted that the mercy petition was forwarded by the Superintendent of Police, Vellore District on 13.05.2016 and the said application will be considered in accordance with law.
5. In view of the submissions made by both sides, this Court is inclined to direct the third respondent-DGP to consider the petitioner's mercy petition dated 20.09.2016 and pass orders, on merits and in accordance with law, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.
6. With the above observations and directions, the Writ Petition is disposed of. No Costs. Consequently, the connected WMP is closed.
