ORDER: (per the Hon’ble The Chief Justice Sri Kalyan Jyoti Sengupta)
This Public Interest Litigation has been filed complaining firstly that without obtaining any sanctioned plan from the municipal authorities, a building has been constructed by the unofficial respondents. Secondly, construction is being done on the Government land.
At the outset, we record that the State Government is not a party.
Learned Standing Counsel for the Municipal Corporation has appeared and produced a document before this Court showing that permission for construction of the building in question has been granted. Therefore, the first problem is not to be addressed or redressed by this Court. However, so far as the second problem is concerned, the petitioner can very well approach appropriate Court dealing with the encroachment and grabbing of the Government land and this can be done even at the instance of a third party on an application being made under the provisions of the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982.
We therefore, close the Public Interest Litigation without passing any interim order. No costs.
Consequently, miscellaneous petitions, if any pending, shall stand dismissed.
