This contempt case has been filed seeking to punish the respondents under Sections 10 to 12 of the Contempt of Courts Act, 1971 for their wilfully and deliberately disobeying the order dated 03.12.2011 made in WPMP. No.35508 of 2011 in W.P. No.28723 of 2011.
W.P. No.28723 of 2011 was filed by the petitioner challenging the Memo No.E1/RIC/278/2011/2125, dated 20.09.2011 and consequently sought direction to the respondents to pay the arrears of salaries to the petitioner for the period from 01.06.2006 to 30.03.2007. Along with the writ petition he also filed WPMP. No.35508 of 2011 seeking direction to the respondents to pay the salary of the petitioner for the period from 01.06.2006 to 30.03.2007 forthwith by suspending the impugned Memo dated 20.09.2011 issued by the 1st respondent, pending disposal of the writ petition.
This Court on 03.12.2011 passed interim direction in WPMP. No.35508 of 2011 directing the respondents to consider the case of the petitioner for payment of salary for the period from 01.06.2006 to 30.03.2007, within a period of two (2) months from the date of receipt of a copy of the order.
Complaining that the said order has not been complied with, the petitioner filed the present contempt case.
Today, when the matter has been taken up for hearing, the learned counsel on either side submitted that the order dated 03.12.2011 passed in WPMP. No.35508 of 2011 has been complied with and therefore, no further orders are required to be passed and the same may be closed.
In view of the submissions made by the learned counsel on either side, this Contempt Case is closed. There shall be no order as to costs.
