An Advocate Commissioner had already been appointed in the suit culminating in the decree for declaration of title and mandatory injunction. The court below was therefore perfectly justified in refusing to appoint another Advocate Commissioner at the execution stage. I however direct the court below to complete the execution proceedings by a team consisting of the following persons:
(i) Amin
(ii) The Taluk Surveyor
(iii) The Advocate Commissioner in O.S. No. 531/2000 The exercise shall be completed within a period of two months from today.
2. I am not issuing notice to the respondents since no rights are decided.
The Original Petition is disposed of.
