Ouseph vs Devassy

High Court Of Kerala|30 May, 2014
|

JUDGMENT / ORDER

The petitioner contends that the application for amendment was allowed without noticing or considering the objection filed by him. The order allowing amendment however reflects that no objection was filed and that the application was heard and allowed. The remedy of the petitioner under such circumstances is to apply for review of the order allowing the application for amendment.
2. Any application for review filed by the petitioner shall be dealt with adverting to the objections (if any filed already) to the application for amendment. The impugned order allowing the application for amendment does not warrant any interference thereof at this juncture. Any application for review shall be dealt with by the Court below within a period of two weeks from the date of its preferment.
The Original Petition is disposed of.
