Petitioner was issued with a permit as per Ext.P2 to remove ordinary earth from the site covered by building permit. Petitioner submitted that he could not extract ordinary earth. Even though he could extract ordinary earth from the site, he could not transport the earth due to the incessant rain. Petitioner approached the Geologist with Ext.P3 for extension of P-form. Petitioner approached this Court seeking a direction to the respondent to consider Ext.P3 application and to renew the P-form for transporting ordinary earth.
2. Considering the facts and circumstances of the case, there shall be direction to the Geologist to renew the P-form for a further period of ten days from the date of receipt of a copy of this judgment after ascertaining the quantity.
The Writ Petition is disposed of as above.
