The present application has been filed by the applicant-accused under Section 439 of Criminal Procedure Code for regular bail.
The applicant accused is charged with having committed offences under Section 399 of the Indian Penal Code, for which, FIR has been lodged being I-C.R.No.119/2009 at Panch Koshi B Police Station, Jamnagar.
After arguing for some time, learned counsel, Mr.H.B. Raval for the applicant seeks permission to withdraw this application at this stage with a liberty to file a fresh application before the Competent Court as now the chargesheet has been filed as stated by learned A.P.P., Mr.Jani on instruction from P.A. Shah, Police Constable of Panch Koshi B Police Station, Jamnagar. Permission, as prayed for, is granted. This application stands disposed of as withdrawn. Rule is discharged.
