THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CIVIL REVISION PETITION No.1299 of 2014 ORDER:
This Revision is filed alleging that the Senior Civil Judge, Gooty, Anantapur District had not disposed of an application for interim injunction I.A.No.81 of 2014 in O.S.No.69 of 2014 restraining the 1st respondent from withdrawing the amounts deposited in Fixed Deposits in respondent Nos.2 and 3 banks.
2. Heard both sides.
3. The said I.A. was filed on 26-03-2014 and the Court below had directed issuance of urgent notice to respondents by R.P.A.D. and posted the matter to 07-04- 2014. This Revision is filed on 09-04-2014 alleging that the Court below was not disposing of I.A.No.81 of 2014. On 24-04-2014 this Court ordered notice before admission to the respondents, and respondent Nos.2 and 3 were directed not to release the fixed deposit amounts in the name of late Anasuyamma until further orders.
4. The 1st respondent has entered appearance through Sri P.Srinivas, Advocate and also filed application to vacate this order.
5. Since the only grievance of the petitioners is that no orders were passed in I.A.No.81 of 2014 on the day when it was filed, I am inclined to dispose of the Civil Revision Petition by directing the Senior Civil Judge, Gooty, Anantapur District to dispose of I.A.No.81 of 2014 in the said suit within a period of three (03) weeks from today positively. Pending disposal of the said I.A, the respondent Nos.2 and 3 shall not release the fixed deposit amounts in the name of late Anasuyamma. It is made clear that this Court has not expressed any opinion on the merits of the contentions of either side. The Court below shall dispose of the said I.A. within the time specified above uninfluenced by the fact that this Court had granted an interim order dt.24-04-2014 or has continued the said order pending disposal of the I.A.
6. The Revision is disposed of with the above directions. No costs.
7. Miscellaneous applications pending if any, in this Civil Revision Petition shall stand closed.
