JUDGMENT / ORDER

Mr.Maulik Shelat, learned advocate for the appellant, seeks permission to amend the address of respondent nos.1/1 and 1/2 in the cause title. Permission is granted.
Despite the fact that pursuant to the order dated 04.09.2012, notice for final hearing was issued only qua respondent nos.1/1 and 1/2 and despite the fact that they were served at new address, none appeared for them.
In above view of the matter and considering the submissions advanced by Mr.Maulik Shelat, learned advocate for the appellant, so also considering the impugned judgment and award rendered by the Tribunal, the appeal deserves consideration and hence, ADMITTED.
ORDER IN CIVIL APPLICATION Mr.Maulik Shelat, learned advocate for the applicant-appellant, seeks permission to amend the address of respondent nos.1/1 and 1/2 in the cause title. Permission is granted.
Having considered the submissions advanced by Mr.Maulik Shelat, learned advocate for the applicant-Insurance Company, so also considering the impugned judgment and award rendered by the Tribunal, RULE returnable on 27.11.2012.
In the meanwhile, there shall be ad-interim stay in terms of Para-3(A) on the condition that on or before returnable date, the applicant-Insurance Company shall deposit the entire awarded amount together with interest and proportionate costs thereon with the concerned claim Tribunal.
