ORAL ORDER IN CIVIL APPLICATION NO.11618 OF 2011 Rule.
Notice as to Interim relief returnable on 30.11.2011. Meanwhile, ad-interim relief in terms of Para-3(A) till then subject to depositing the entire awarded amount along with proportionate cost and interest on or before returnable date before the concerned Tribunal.
After depositing the entire decreetal amount along with proportionate cost and interest, so far as the disbursement is concerned, the Trial Court is directed to disburse 30% of the amount deposited to the present opponent no.1-original claimant by Account Payee Cheque in the name of the original claimant-Opponent no.1 after proper verification.
Remaining 70% amount shall be invested by the Tribunal in any nationalized bank in Fixed Deposit in the joint name of claimant and Nazir of the Tribunal initially for a period of three years and such investment shall be renewed from time to time until the appeal is finally disposed of. The original FDR(s) shall be retained with the Nazir of the Tribunal. The original claimant is entitled to get periodical interest thereon.
In view of the above, this Civil Application is disposed of. Rule is made absolute accordingly.
