Prima facie, on the date of accident i.e. 10.04.1984,. the Policy was not in existence. The Policy was for the period from 29.5.1984 to 28.5.1985. However, an endeavour is made that no claim bonus was given. The finding of the Tribunal on this aspect is not clear. In that view of the matter, with a view to enable Mr. Y.M. Thakkar, learned counsel appearing for the owner, namely, Shri Natubhai Chhotabhai Amin to produce on record the Insurance Policy to establish that the vehicle in question was insured with the Insurance Company for the previous year of the accident, the matter is adjourned to 23.02.2012.
