JUDGMENT / ORDER

The issue involved in the present appeal is squarely covered by a decision of the Apex Court in the case of National Insurance Co. Ltd. vs. Gurumallamma and another reported in 2009(9) SCALE 764 . However, Mr. Desai has filed sick note. As a last chance, matter is adjourned to 01.03.2012. It is clarified that on the next date of hearing Mr. Desai shall either appear in person or make alternate arrangement, failing which appeal shall be proceeded ex-parte.
