JUDGMENT / ORDER

The appeal has been admitted on one of the ground that there is a breach of terms of policy and therefore, the appellant is entitled for a right to recovery against the owner of the vehicle.
In view of the above, there is no dispute with regard to the entitlement of the claimants/respondents to receive compensation. Accordingly interim order dated 22.2.2010 is modified and it is provided that the claimants/respondents would be entitled to release of the balance 50% of the amount also but on furnishing adequate security to the satisfaction of the Tribunal.
The stay vacation application is accordingly disposed of. Stay order dated 22.2.2010 is confirmed with the above modification.
