JUDGMENT / ORDER

The appeal apart from the other grounds has been filed by the Insurance Company on the allegation that the vehicle was being driven in breach of the policy as the driver was not having a valid and effective licence.
In view of above, the contention that the appeal is not maintainable for want of permission under Section 170 of the Motor Vehicles Act cannot be accepted.
Otherwise also there is no reason to vacate the interim order. Stay vacation application is rejected. Stay order is confirmed. Office to proceed.
The hearing of the appeal would be confined to the breach of condition.
