Heard learned counsel for the parties.
By way of this appeal, the Oriental Insurance Co Ltd has felt aggrieved by the judgement and decree (award) dated 21.08.2004 passed by Additional District Judge/ Motor Accident Claims Tribunal, Muzaffar Nagar in Motor Accident Claim Petition No. 88 of 1996 (Ram Charan Sharma v. Oriental Insurance Co. Ltd. and others) awarding a sum of Rs.16,300/- with 6% rate of interest.
This is an appeal of the year 2004. The respondent no. 1, 3, 4 and 5 deemed to have been served. The awarded amount is Rs.16,300/- which is a meagre amount for the injury case, the Insurance Company has brought this matter under challenge contending that there was a head-on collision between Jeep Trakker and Metadoor. In claim petition no. 88 of 1996 arising the Tribunal, fasten the liability of owner of the Metadoor.
The appeal is dismissed on smallness of the amount, as the amount would have been already deposited as per the interim order however this will not bind the Insurance Company in other matters where the amount awarded may be the ground of challenge.
