Heard Sri Tarun Verma, learned counsel for the petitioner and the learned Standing Counsel for the respondents no.1 & 2.
In view of the nature of the order sought to be passed it is not necessary to issue any notice to the respondents no.3 to 6.
The petitioner it appears has initiated proceedings under Section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 against the respondents no.3 to 6 through Case No.38 of 217 but it is stated that till date no order has been passed. The matter is stated to be pending before the respondent no.2-Additional District Magistrate (Finance & Revenue), Meerut.
No useful purpose would be served by keeping this writ petition pending.
We dispose of this writ petition with a direction to the respondent no.2-Additional District Magistrate (Finance & Revenue), Meerut to decide the Case No.38 of 2017 expeditiously preferably within a period of four months from the date a certified copy of this order is received in his office.
Needless to say before any order is passed by the respondent no.2 he shall also give an opportunity of hearing to the respondents no.3 to 6.
