JUDGMENT / ORDER

This is a petition filed under Sec.24 of the Code of Civil Procedure read with Article 227 of the Constitution of India, seeking transfer of OP No.297/2014 pending before the Family Court, Kasaragod to the Family Court, Thiruvananthapuram.
2. The marital relationship between the petitioner and the respondent ran into rough weather and litigation began. The respondent instituted O.P.No.297/2014 before the Family Court, Kasaragod for restitution of conjugal rights. The petitioner would say that she is permanently employed at Thiruvananthapuram and she has a child and since her parents are aged, she has to look after them, she finds it difficult to travel to Kasaragod to attend the routine posting of the case. The petitioner also points out that she has nobody to accompany her to Kasaragod. She also pointed out that the respondent is employed abroad and no prejudice is caused to him by having the matter transferred to the Family Thiruvananthapuram.

3. Notice was served to the respondent. But he has not entered appearance. No objection is also seen filed.
In the result, the transfer petition is allowed and OP 297/2014 pending before the Family Court, Kasaragod shall stand transferred to the Family Court, Thiruvananthapuram.
