JUDGMENT / ORDER

The petitioner has filed Ext.P2 petition (I.A. No. 792/2014) to set aside the ex-parte decree in O.S. No. 126/2000 on the file of the court of the II Additional Subordinate Judge of Thiruvananthapuram. Ext.P2 application is accompanied by Ext.P3 application (I.A. No. 793/2014) to condone the delay of 11 years and 105 days. The respondent decree holder has attached the property of the petitioner/judgment debtor in execution of the decree for money.
2. I direct the court of the II Additional Subordinate Judge of Thiruvananthapuram to dispose of Exts.P2 and P3 applications with notice to the parties within one month. The delivery of the property in execution of the decree in O.S. No. 126/2000 can go on as scheduled and would however be subject to the orders passed on Exts.P2 and P3 applications.
The Original Petition is disposed of.
