Heard learned counsel for the petitioner, Sri Mahesh Narain Singh for the respondent Nos. 2 to 4 and Sri S.K. Mishra for the fifth respondent.
Sri M.N. Singh learned counsel raises a preliminary objection to the maintainability of the writ petition on the ground that the petitioner has a statutory alternative remedy of instituting a revision referable to Section 41(3) of the U.P. Urban Planning And Development Act, 1973. The petition is consequently dismissed on the ground of alternative remedy.
All contentions on merits of respective parties are left open.
