JUDGMENT / ORDER

Respondent Petition under Section 437 & 439 of Cr P.C praying that in the circumstances stated in the memorandum of Grounds filed herein , the High Court may be pleased to enlarge the petitioner/ accused on bail pending enquiry and trial.
The petition coming on for hearing, upon perusing the memorandum of grounds filed herein and upon hearing the arguments of SRI P. GIRISH KUMAR, Advocate for the Petitioner and of Public Prosecutor for the Respondent , the Court made the following.
ORDER:
The petitioner is the sole accused. He seeks for grant of bail. He allegedly committed offences under Section 302 IPC and Section 3(2)(v) of the SCs & STs (POA) Act.
It is alleged by the learned counsel for the petitioner that the case was falsely foisted against the petitioner and that the petitioner is innocent of the offences.
Learned Additional Public Prosecutor submitted that the investigation is still in progress.
The petitioner is 65 years old. It would appear that there is no past criminal record against the petitioner. In view of the age of the petitioner and the absence of earlier criminal record, I consider it appropriate to enlarge the petitioner on bail. However, where the investigation is still in progress, it would be appropriate to enlarge the petitioner on bail on terms only.
Consequently, the Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs.10,000/- (Rupees ten thousand only) with two sureties in a likesum each to the satisfaction of the Special Mobile Judicial First Class Magistrate, Guntur. After his release, the petitioner shall appear before the Station House Officer, Nallapadu Police Station, Guntur, on every Monday, Wednesday and Friday, between 9 am and 6 pm for a period of three (3) months.
