Heard Sri Ram Murti Tripathi, learned counsel for the petitioner, Sri Sant Ram Sharma, learned counsel for the respondent nos. 5 and 6 and learned Standing Counsel for the State respondents.
The petitioner is a complainant, who had made a complaint against the respondent no.4 alleging that he has occupied a land, which is a public land and submits that no action is being taken against the respondent no.4 and therefore, he has filed the present writ petition.
It is to be noted that the complainant can make a complaint, but cannot file a writ petition to issue a direction to the authorities to act upon his complaint, as the petitioner is not a person aggrieved, whose neither statutory nor fundamental right appears to have been violated.
The writ petition is not maintainable and it is, accordingly, dismissed.
