Onkar Nath & Others vs State Of U.P., Thru. Prin. ...

High Court Of Judicature at Allahabad|22 June, 2010

JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioners and learned Additional Government Advocate.
Under challenge in the instant writ petition is the FIR relating to Case Crime No.181 of 2010 under Sections 467, 468, 420, I.P.C., Police Station Manikpur, District Pratapgarh.
We have gone through the contents of the FIR and other documents annexed thereto.
Arguments advanced by the learned counsel for the petitioners is that parentage of the petitioners is Dwarika Prasad whereas complainant is also Dwarika Prasad and Kisan Credit Card which has been got prepared upon the land belonging to opposite party no.5 is misconceived.
Since at no point of time, Kisan Credit Card was never got prepared by the petitioners with respect to the land of opposite party no.5.
This argument as to whether Kisan Credit Card was got prepared with malafide intention by committing fraud or cheating is not the matter of consideration before this Court and it cannot be looked into at this juncture.
Petition is misconceived and is accordingly dismissed.
