Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Omveer who is involved in Case Crime No. 648/2017, under Section 304 I.P.C., Police Station- Line Par, District Firozabad.
As per prosecution version, 29.07.2017 at about 8:00 a.m., a dead- body of unknown person aged about 25 years was recovered, later on which is identified as Subhash Chandra. During investigation, the name of applicant came into light.
It is contended by learned counsel for the applicant that there is no evidence against applicant. Applicant has no criminal antecedent. Veer Singh, in his statement under Section 161 Cr.P.C. stated that on 28.07.2017 at about 10:30 p.m. deceased Subhash was seen with applicant and co-accused Manoj Kumar. The role of applicant is similar to that of co-accused Manoj Kumar who has been granted bail by this Court vide order dated 20.02.2018 passed in Criminal Misc. Bail Application No. 6022 of 2018, copy of which produced for perusal.
Learned A.G.A. has opposed the prayer for bail.
The role of applicant is similar to that of co-accused Manoj Kumar.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Omveer be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
