Heard learned counsel for the applicant and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the further proceeding of Criminal Case No.04 of 2017 (State Vs. Omveer Singh and others) arising out of Case Crime No.256 of 2017, under Sections 7/13 (1) D and 13(2) Prevention of Corruption Act, Police Station Bisauli, District Badaun.
The Submission is that the alleged offence is not made out against the applicant. He has been falsely implicated being Collection Amin for demanding Rs.5,000/-. Learned counsel for the applicant has submitted that the applicant was arrested from crowded place from the shop of the complainant.
In view of the submission, it is open for the applicant to move discharge application before the Court below within a period of one month from today. If such an application is filed the same shall be decided by the Court below within a period of two months thereafter. The applicant is already on bail.
Till the discharge application is decided, no coercive measures shall be taken against the applicant.
With the aforesaid directions, application stands disposed of.
