Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the private respondent.
The petitioner has preferred the present petition inter-alia with the prayer to direct the defendant-respondents from interfering in any manner in peaceful possession of the plaintiff/petitioner over the land in question.
It appears from perusal of record that in the civil suit filed by the petitioner being Original Suit No.118 of 2020, an application under Order 7 Rule 11 was filed by the defendant- respondents. It further appears from perusal of the order-sheet that due to the pendency of the aforesaid application no orders were passed by the court below for grant of interim injunction in favour of the plaintiff-petitioner.
It is argued by learned counsel for the petitioner that since the interim injunction was not granted, the plaintiff-petitioner is suffering irreparable loss.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to pass appropriate orders in accordance with law on the interim injunction application filed by the plaintiff/petitioner most expeditiously and preferably within a period of two months from the date of production of self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties Order Date :- 6.1.2021 Pramod Tripathi
