Heard Mr. Amit Kumar Singh, learned counsel for the applicant and the learned A.G.A. for the State.
The application under Section 482 Cr.P.C. has been filed challenging the summoning order dated 24.8.2016, passed by the First Additional Civil Judge (J.D.)/(J.M) Shahajanpur in complaint Case No. 814 of 2016 (Nakhatra Pal Vs. Omveer and Others), under sections 452, 323 IPC, P.S. Mirzapur, District Shahajanpur as well as the entire proceedings of above mentioned complaint case.
Learned A.G.A. points out that in the present case, non bailable warrant was issued against the applicant by the Court below vide order dated 16.1.2017. The same is explicit from the perusal of the order sheet of the complaint case, copy of which is on the record as Annexure-4 to the affidavit. The non bailable warrant has been operating against the applicant for more than 8 months. The applicant has chosen not to appear before the Court below, in spite of the expiry of the aforesaid period. This shows a total disrespect of the process of the Court.
In view of the above, no occasion arises before this Court to entertain the present application. It is, accordingly, dismissed.
