Heard Sri Harsh Vikram, learned counsel for the petitioners, Sri Neeraj Dube, learned counsel for the National Highway Authority of India and learned Standing Counsel for the State-authorities.
Certain land was acquired by the National Highway Authority under the National Highway Authority Act and an award was determined against which the petitioners filed an application for enhancement of award and the arbitrator enhanced the award that was also challenged by the National Highway Authority, which was dismissed. The grievance of the petitioners is that in spite of the aforesaid fact, awarded amount has not been paid to the petitioners.
Sri Neeraj Dube, learned counsel for the National Highway Authority submits that enhanced awarded amount has also been deposited with the Kotak Mahindra Bank on 20.7.2018 in the account of the SLAO and it is the SLAO, who is the competent authority to pay the amount to the petitioners.
Considering the aforesaid facts and circumstances, the writ petition is disposed of with the observation that in case, the amount has been deposited by the National Highway Authority in the joint account of the SLAO (respondent no. 4) and there is no legal impediment, the same shall be paid to the petitioners without unnecessary delay.
