Learned counsel for the petitioner submits that he may be permitted to correct the description of respondent no.2 as Regional Higher Education Officer, Gorakhpur Region, Gorakhpur. He is permitted to do so.
The petitioner claims himself to be a class IV employee of Shiv Harsh Kisan Post Graduate College, Kushi Nagar. The said college is affiliated to Gorakhpur University and is a non- government aided college. According to the learned counsel for the petitioner, by virtue of government order dated 28.5.1984, 20% posts that of class III in the institution are to be filled by promotion from amongst class IV employees .
According to the learned counsel for the petitioner, there are 11 posts of class III in the institution. Nine posts are already filled by direct recruitment and two posts remains vacant under promotional quota. It is further submitted that the petitioner has requisite qualification to be considered for promotion on class III posts under promotional quota but his claim is not being considered.
The writ petition is disposed of with the direction to respondent No.2 to consider the claim of the petitioner and pass appropriate order in accordance with law as far as possible within a period of three months from the date of filing of a representation along with a certified copy of this order.
