Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicants contended that earlier there was compromise in between the parties. Subsequently, in absence of the applicant, N.B.W. has been issued.
Learned AGA opposed the prayer.
Considered the submissions of learned counsel for the parties. If this fact is correct that the matter has been settled in between the parties then no useful purpose would be served to continue the criminal proceeding.
Hence, if discharge application/objection is moved by the applicant within three weeks before the court concerned, it is expected that the same shall be considered and decided by a reasoned and speaking order, expeditiously, at appropriate stage, in accordance with law. Till disposal of the application on merit, no coercive action shall be taken against the applicant in Case No. 2667 of 2015 arising out of Case Crime No. 639 of 2014, under Sections 498A, 323, 504, 506 IPC and 3/4 D.P.Act, P.S. Kotwali, District Etawah.
With aforesaid observations and direction, the present application u/s 482 Cr.P.C. is finally disposed off.
